PRIVACY NOTICE

Hello. We are Firsti Delivery Proprietary Limited, and we bring to you the TaDa Drinks Delivery mobile application and website (the ‘Platform’). Here's how we protect your personal information and respect your privacy (the “Notice”).

When you use the Platform you agree that we use your personal information in accordance with this Notice.

  1. What personal information do we use?

Contact information: the personal information that you give us when you place an order, create your account, register for our loyalty program, participate in our promotions and competitions or when you contact us through our channels. These are your full name, email, phone number, date of birth and username.

Location: you have to enter your address to see available Retailers and prices. We may also obtain your approximate location from your IP address.

Purchases and preferences: items purchased and products in your cart, your ordering preferences, amount charged and method of payment, billing and shipping details, transaction details and purchase history.

Use of the application: we collect your ratings, reviews and comments, dates and times you accessed the Platform, app features, pages, and banners you interact with, page response times and time spent on our Platform. We also collect data about the devices used to access our Services, including hardware models, IP addresses or other unique device identifiers, operating systems and versions, software, preferred languages, advertising identifiers, device movement information, and data from your mobile network.

Communication data: For your security, we collect data about the communications you have in the app with Retailers and Delivery Partners or when you contact customer support. This includes the date and time, as well as the content of the messages.

We do not collect any special personal information.

  1. How and why do we use your personal information?

To provide our Service: in relation to the ordering, sale and delivery of the Products, to enable the Retailers, the Delivery Partners and the payment processors to sell and deliver the Products to you. To facilitate communication between you and the Retailers and Delivery Partners, and to send you notifications related to your Orders.

To respond to your queries and maintain the security and integrity of our Service: To provide you with support and respond to your questions and complaints. Also to prevent and detect fraud or violations of our Terms, including verifying your identity and the accurateness of the information you provide to us.

For research and development: To conduct statistical analysis and market research, to improve your experience using our Platform and our product selection. 

For marketing and advertisement: To contact you regarding current or new Products or services offered by us, the Retailers or the Delivery Partners (unless you have opted out from receiving marketing material from us).

Also to inform you of new features, special offers and promotional competitions offered by us, the Retailers or the Delivery Partners (unless you have opted out from receiving marketing material from us).

To market our Service and that of companies affiliated or related to our corporate group and measure the effectiveness of these advertisements. This includes:

•sending emails, text messages, push notifications and messages in the app about marketing or advertisements of our Services, promotions, and/or news;

•delivering our advertisements in third party’s applications or websites, including sharing encrypted email addresses and device or user identifiers with advertising partners (such as Meta, Google, TikTok, and Twitter) to personalize such ads based on your interests;

•showing third-party advertising in our Platform. These are advertisements for third-party products or services that are personalized based on your observed and/or inferred interests and characteristics, which we determine using data such as your location, purchase history, usage and demographic data.

For other legal reasons: To identify, prevent or detect any fraud, money laundering or crime, or to carry out regulatory checks. To investigate or respond to claims or disputes related to the use of the Service, to comply with applicable laws and regulations, or pursuant to legal process or request. Also in the event that we merge with another company or if all or a substantial part of our assets are acquired by another company.

We will not, without your express consent, use your personal information for any purpose other than as set out above.

  1. Who do we share your personal information with?

We may have to transfer your personal information to a destination outside of the Republic of South Africa, including to cloud storage providers located in the United States. In such cases, rest assured that we will transfer your data with appropriate measures to keep it safe.

  1. How do we protect your personal information?

We have physical, electronic and organizational procedures to protect your personal information. We will ensure that all of our employees, third party service providers, divisions, affiliates and partners (including their employees and third-party service providers) that have access to your personal information are bound by appropriate and legally binding confidentiality obligations in relation to your personal information.

 We are committed to protecting your personal information using best practices including encryption of data in transit and at rest. We continually evaluate new technology to keep improving.  But remember: you are also responsible for adopting the necessary security measures to protect your personal information. We recommend that you keep your password secret and change it regularly, and use a safe navigation system and avoid public Wi-Fi networks.

  1. How long do we keep your personal information for?

We will only keep your personal information for the time necessary to fulfil the purposes indicated in clause 2, unless we are required by law to do so, or you consent to us retaining such information for a longer period.

  1. Your rights and how to exercise them

You have the right to require us to update or correct any inaccurate personal information we hold about you, as well to stop processing your personal information if you no longer wish to receive direct marketing communications from us, in case you have opted in. You also have the right to request us to provide a copy of the personal information we hold about you or to inform you further about how we use it.

You also have the right, in certain circumstances, to require us to delete your personal information; to object to the processing of your personal information; to restrict our processing; and to require us to transmit your personal information to you or to transfer or have them transferred to another company.

You can exercise your rights in your Account, in the 'Help and Support' section, by clicking on 'Contact us' and filling out the form with the corresponding information.

Your request will be handled by our team and we will answer you as soon as possible, in compliance with the deadlines established by local legislation. We expect our procedures to deal fairly and promptly with your request. However, if you are still dissatisfied, you have the right to file a claim with the Information Regulator.

Cookies are small text files that are stored in your browser, application or device and allow us to remember information about your visit. We use cookies and similar technologies (such as web beacons and pixels) to:

We (directly or through third parties) perform audience measurement and analytics services, present our ads to you on the Platform and/or on third-party sites, and receive information about their origin (i.e., which ads bring you to our Platform) and its performance.

You can agree to tracking and therefore provide us information that helps us understand the reach of our campaigns, allocate our resources, and improve our Services. Please bear in mind that we might still serve you with ads if you do not consent – these will not be personalized according to your information and preferences.

You have the right to decide whether to accept or reject cookies. We will always prompt you the first time you visit our Platform and you can change your preference anytime.
